These Terms are legally binding between you (referred to as "User" or "you") and novelrush (referred to as "we," "us," or "novelrush"), and they incorporate our Privacy Policy and any other documents referenced herein. It is your responsibility to review the Privacy Policy, as it outlines how we collect, use, and protect your personal information.
By accessing, browsing, or using any part of the Services, you acknowledge that you have read, comprehended, and agreed to be bound by all provisions of these Terms, including the Privacy Policy and any referenced documents. If you do not agree with any term or condition contained herein, you must refrain from using the Services in any way.
Your use of the Services constitutes your voluntary acceptance of these Terms, creating a legally enforceable agreement between you and novelrush. This agreement applies to all your interactions with the Services, regardless of how you access them (e.g., via web browser, mobile app).
We reserve the right to update, revise, or modify these Terms at any time, at our sole discretion. When we make material changes to the Terms, we will notify you through one or more of the following methods: in-app notification, email to the address associated with your account, or by updating the "Effective Date" at the top of this document. Material changes will take effect 14 days after we provide notice of such changes; if required by applicable law, changes may take effect immediately.
Your continued use of the Services after the effective date of any modified Terms constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Services immediately.
To access and use the Services, you must meet the following eligibility criteria:
Certain features of the Services may require you to create a novelrush account. When creating an account, you must provide accurate, complete, and current information. You agree to update your account information promptly if any details change (e.g., email address, contact information) to ensure it remains accurate.
Your novelrush account is personal to you, and you are solely responsible for maintaining the confidentiality of your account credentials (including your username, password, and any other access codes). You are also responsible for all activities that occur under your account, whether authorized by you or not. If you suspect any unauthorized access to your account, or if your credentials are lost or stolen, you must notify novelrush immediately to minimize potential damage.
You may request the deletion of your account at any time through the "Account Settings" section of the Services. Please note that account deletion is irreversible: once your account is deleted, all data associated with your account (including user-generated content, account history, and preferences) will be permanently removed, and you will lose all access to the Services. We may retain certain data as required by applicable law.
You may choose to register for a novelrush account using third-party authentication services (e.g., Google, Apple). By using a third-party account to log in, you authorize that third party to share certain information (such as your name and email address) with novelrush to facilitate account creation. You also agree to comply with the terms of service and privacy policies of the third-party service.
novelrush reserves the right to suspend or terminate your account, in whole or in part, at any time and without prior notice, if we determine, in our sole discretion, that you have violated these Terms, engaged in fraudulent or illegal activity, violated applicable laws, or if your account has been inactive for an extended period. We may also suspend or terminate your account in response to legal requests or to protect the safety and security of the Services, other users, or novelrush.
novelrush grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for your personal, non-commercial use only. This license does not allow you to use the Services for any commercial purpose, including but not limited to selling access to the Services, advertising, or promoting third-party products or services.
You agree not to engage in any of the following activities when using the Services:
You are solely responsible for obtaining and maintaining the necessary devices (e.g., smartphones, computers), software, and internet connectivity required to access and use the Services. novelrush is not liable for any issues, delays, or disruptions in your use of the Services caused by your device, internet connection, or third-party software.
novelrush offers both free and premium (paid) versions of the Services. Free Services may include advertisements, limited features, and usage caps. Premium Services provide additional features, ad-free access, and other benefits, as outlined on our website or App.
By subscribing to a Premium plan, you agree to pay the applicable fees (including any taxes, surcharges, or fees) for the billing cycle you select (e.g., monthly, annual). All subscription fees are non-refundable unless required by applicable law.
All Premium subscriptions are set to auto-renew at the end of each billing cycle, unless you disable auto-renewal at least 24 hours before the end of the current cycle. You can disable auto-renewal through your account settings on the Services or through the third-party platform (e.g., App Store, Google Play) used to purchase the subscription.
By subscribing to a Premium plan, you authorize novelrush (or our designated payment processor) to charge your selected payment method (e.g., credit card, PayPal) for the subscription fees. Billing cycles are based on your initial purchase date. You are responsible for ensuring that your payment method is valid and up-to-date. You can manage your payment details through your account settings.
You may cancel your Premium subscription at any time. Upon cancellation, you will retain access to the Premium Services until the end of the current billing cycle. No refunds will be provided for partial billing cycles, unless required by applicable law. If you cancel within the applicable refund period (if offered), you may be eligible for a refund in accordance with our refund policy.
novelrush may adjust the price of Premium subscriptions at any time. We will provide you with at least 30 days’ notice of any price increase. Your continued use of the Premium Services after the price increase takes effect constitutes your acceptance of the new price.
novelrush does not guarantee that any content (including UGC or novelrush Content) will remain available on the Services indefinitely. We reserve the right to remove, edit, or hide any content at any time, for any reason, including but not limited to legal requirements, licensing restrictions, or violations of these Terms.
We do not endorse, verify, or assume responsibility for the accuracy, completeness, or appropriateness of any UGC posted by users. You access and use all content on the Services at your own risk.
When using the Services, you agree to conduct yourself in a respectful and lawful manner. You may not post, upload, or share any content that is illegal, harmful, threatening, abusive, harassing, defamatory, discriminatory, obscene, or infringing on the rights of others. You also agree not to engage in any conduct that harms other users, novelrush, or the Services.
novelrush reserves the right to review, moderate, and remove any content that violates these Terms or our community guidelines. We also reserve the right to restrict or terminate the accounts of users who repeatedly violate these Terms. We provide reporting tools to allow users to report inappropriate content or conduct, and we will review all reports promptly.
The Services may contain links to third-party websites, applications, or services, or may integrate with third-party tools. novelrush does not control, endorse, or assume any responsibility for these third-party services. Your use of third-party services is subject to the terms of service and privacy policies of those third parties. novelrush is not liable for any damages, losses, or issues arising from your interaction with third-party services.
The Services are provided on an "as is" and "as available" basis, without any warranties of any kind, whether express or implied. novelrush disclaims all implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or secure, or that any content will be accurate or available.
To the fullest extent permitted by applicable law, novelrush and its affiliates, directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including but not limited to damages for loss of profits, data, or goodwill) arising out of or in connection with your use of the Services, even if novelrush has been advised of the possibility of such damages. Our total liability to you for any claim arising out of or in connection with these Terms or the Services shall not exceed the amount you paid to novelrush for the Services in the past 12 months, or $100 if you have not paid any fees.
You agree to use the Services in compliance with all applicable local, national, and international laws, regulations, and ordinances. This includes, but is not limited to, laws related to data privacy, intellectual property, and online conduct.
If we determine that you have violated these Terms, we may notify you of the violation and request that you correct your conduct. For severe or repeated violations, we may suspend or terminate your account, remove your content, refuse to provide you with the Services, pursue legal action against you, or report your conduct to the appropriate authorities.
You agree to indemnify, defend, and hold harmless novelrush and its affiliates, directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney’s fees) arising out of or in connection with your use of the Services, your violation of these Terms, or your user-generated content.
novelrush respects the intellectual property rights of others. If you believe that any content on the Services infringes your copyright or other intellectual property rights, please contact our designated agent with the following information: (1) your name and contact information; (2) a description of the infringing content; (3) a description of your intellectual property right; (4) a statement that you have a good faith belief that the use of the content is not authorized by you, your agent, or the law; and (5) a statement, under penalty of perjury, that the information you provide is accurate and that you are the owner of the intellectual property right or authorized to act on behalf of the owner.
We will process all valid infringement claims in accordance with applicable law and may remove or disable access to the infringing content.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed from the Terms, and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy and any other documents referenced herein, constitute the entire agreement between you and novelrush regarding your use of the Services, and supersede all prior or contemporaneous agreements, understandings, or representations, whether written or oral.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, excluding its conflict of laws principles.
Any dispute, claim, or controversy arising out of or in connection with these Terms or the Services shall be resolved through binding, individual arbitration administered by the American Arbitration Association (AAA) in accordance with the AAA’s Commercial Arbitration Rules. Arbitration shall take place in Delaware, USA, or at a location mutually agreed upon by the parties. You and novelrush waive the right to a jury trial and the right to participate in a class action or other collective proceeding.
Our Privacy Policy explains how we collect, use, store, and protect your personal information when you use the Services. By using the Services, you agree to the terms of our Privacy Policy, which is incorporated into these Terms.
You may terminate your use of the Services at any time by deleting your account or ceasing all access to the Services. novelrush may terminate the Services or your access to the Services at any time, for any reason, with or without notice.
Upon termination of your account or the Services, all licenses granted to you under these Terms shall immediately terminate, and you shall cease all use of the Services. Sections of these Terms that by their nature should survive termination (including but not limited to intellectual property rights, indemnification, limitation of liability, and dispute resolution) shall remain in full force and effect.
